You have already determined that you will offer José a plea deal. You need to determine what type of plea deal you want to offer. On the one hand, the evidence is strong enough that you think you could win if you went to trial. Further, securing a plea that does punish José is often considered a win. On the other hand, this is José's first offense, and mitigating factors (he was provoked by an individual) seemed to have played a role. You can either reduce the amount of charges against him, or lessen the charges.
