Carlos inspected Ted's jet-ski with a view to purchase. Ted told him the engine was in 'top condition' and he had maintained the servicing of the craft. Carlos did not know much about engines and just went along with this statement. They signed a contract which was silent on the state of the engine. The engine seized up on the first day out and a mechanic told Carlos it was in poor condition and appeared never to have been serviced. Carlos is now in great confusion but he hopes to get his money back. Write an email to Carlos to explain whether it is possible for him to recover his loss based on the following laws and principles:
a. Statue, common law, and equitable principles relating to contract and consumer laws;
b. The principles and rules for the formation of contracts under common law;
c. The equitable principle of unconscionability. (Ensure the language used in your email suits Carlos. Do not assume Carlos has the same knowledge of contract and consumer law as you. Do explain where there are any technical terms that may be beyond Carlos's understanding.)
