Dato’ Kaisar purchased a bungalow house located in Denai Alam worth RM2.5million. He wants to give the house for his son, Kamarul and his daughter in law, Jenab to live in. The house was put in the Dato’ Kaisar’s name alone. He paid the deposit as a wedding gift and promised the couple that if they paid the mortgage installments, he would transfer the house to them. The promise then was put in writing. Later, Dato’ Kaisar died caused by heart attack, and the wife, Datin Kasmah inherited the house. Jenab continued to pay the mortgage installments and consequently settled the whole payment. However, Jenab’s mother-in-law, Datin Kasmah refused to transfer the house to the couple by saying that the house was inherited to her after her husband had died. Advise Jenab whether she and her husband entitled to get the house in the lights of intention to create legal relation.
